How Hazelbrook Legal Collects Information

In most instances we will collect personal information directly from the person to whom the information relates, or the organisation of which that personal is an employee, director or principal. However, we may also collect personal information about individuals from the following third parties:

  • law enforcement bodies;
  • publicly available records;
  • public registries;
  • court or tribunal records;
  • ratings agencies;
  • search agencies;
  • regulatory and licensing bodies;

  • recruitment agencies;

  • social media (such as LinkedIn and Facebook); and
  • Photographers (taking photographs or videos at Hazelbrook Legal events).

When we obtain personal information from third parties to whom you refer us, we will assume and you must ensure that you have made that third party aware that you have referred us to them and of the purposes involved in the collection, use and disclosure of the relevant personal information.

If you choose not to participate in these activities, your choice will in no way affect your ability to use any feature of this website.

If you do not provide us with some or all of the personal information we ask for, we may not be able to offer certain services to you or to our clients on your behalf.

How Hazelbrook Legal Holds Information

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure.

Our premises are in secure buildings with access to our offices only by passcode or security card holders. Our IT systems are password protected and we conduct regular cybersecurity checks of staff equipment and procedures, as well as ongoing training. We maintain up-to-date anti-virus software to protect our systems and your personal information from computer viruses. All Hazelbrook Legal employees are required to treat personal information held by Hazelbrook Legal as confidential, as part of their employment contract.

The transmission and exchange of information is carried out at your own risk. The internet is an insecure medium and users should be aware that there are inherent risks transmitting information across the internet. Information submitted via unencrypted email or web forms may be at risk of being intercepted, read or modified, and we cannot guarantee the safety of any information you transmit to, or receive from, us.

Purpose for which Information is Collected, Held, Used and Disclosed

Third Party Providers

We regularly engage third-party service providers to provide software, platforms, and other services to improve our functionality and performance. We take appropriate contractual measures to ensure any agreements with these third parties provide appropriate privacy protections. The third-party service providers also have their own privacy policies in place where they hold, or are otherwise in control of, your personal information.

Direct Communication and Marketing

If you are a client or have otherwise expressed interest in our services and provided us with your contact details, we may send emails to you to disseminate information including information about legal updates (such as newsletters and alerts), market our services, or facilitate participation in Hazelbrook Legal events.

We use an email management system to automate the management and dispatch of emails. The personal information that the email management system collects and holds about you is used by us to:

  • ensure you only receive the correspondence you have informed us you wish to receive;
  • insert your personal information into our communications with you;
  • determine whether the information that we send is suitable to your interests and needs;
  • confirm the email address you provided is still operational and that the emails we send are being received by you;
  • update requests that you make to unsubscribe from communications; and
  • review the effectiveness and relevance of our emails through the collection of statistical information.

Disclosure of Personal Information Overseas

We may disclose personal information to external service providers located overseas (including England) so that they can provide us with services in connection with the operation of our business, such as data storage.
If you apply to us for employment, and have lived or worked overseas, we may disclose your personal information to overseas recipients for the purposes of gathering information to assess your application. If you have previously worked for us, and provide our details to a prospective employer or recruitment agency located overseas, we may disclose your personal information to that entity to assist them to assess your application.

Aside from the purposes set out above, we are generally not likely to disclose personal information to overseas recipients. However, in the course of acting for some clients it may become necessary or desirable to disclose personal information to overseas recipients. The countries in which these overseas recipients may be located will depend upon the individual circumstances of our client's matter, and it is not practicable to specify them in this Privacy Policy.

Access to and Amendment of Personal Information

You have a right to request access to personal information that we hold about you, and request its correction if it is inaccurate, out of date, incomplete, irrelevant or misleading. Subject to any exceptions under the Act, we will respond within a reasonable timeframe after the request is made.

We will not charge you for lodging a request to access your personal information but in accordance with the Act, may charge for reasonable administrative costs which will be determined on a case-by-case basis.

We have the right to reasonably refuse a request for access to personal information under the Act. If this occurs, we will provide a written notice within a reasonable timeframe detailing the reasons for refusal where it is reasonable and appropriate to do so, and the complaint mechanisms available to you.
